Witham Town were left frustrated, after promotion-chasing Ware came from behind to win 3-1 at the Spicer McColl Stadium, Spa Road.
Town had taken the lead from the penalty spot after 11 minutes.
Cody McDonald found himself through on goal but was brought down by a Ware defender in the area.
A penalty was awarded and it seemed as though the Ware player was the visitors' last man back, meaning a red card.
But the referee chose not to send him off, much to the disdain of the Town bench, Julian Edwards scored from the spot but Ware were level again on the half hour mark through John Frendo and Danny Gudgeon struck five minutes before half-time to give Ware the lead.
To compound Witham's misery, striker Edwards broke his foot following a heavy tackle at the start of the second half.
And although McDonald hit the post, Frendo made the points safe for Ware with three minutes to go.
