A NUISANCE neighbour has been ordered to pay more than £1,100 after he failed to clear up mounting piles of rubbish from his garden.

Daniel Willett, 38, was evicted from Deanery Gardens, Braintree, after a long-running battle with the council over waste.

The council began receiving complaints in January that the back garden of the address contained a large amount of domestic waste.

Despite being sent letters and advice, Willett failed to clear the waste and allowed it to rot, causing odour and attracting vermin.

In April, he was served with a Community Protection Notice as the council believed the situation was having a detrimental effect on the quality of life of others nearby.

Willett failed to clear the waste and was served with a £100 fixed penalty notice, which he also failed to pay.

He was then evicted from the property and the landlord had to clear the waste.

Willett did not attend the hearing at Chelmsford Magistrates’ Court and was convicted in his absence.

He was fined £660, ordered to pay a victim surcharge of £20 and full costs to the council of £544.

Wendy Schmitt, cabinet member for environment and place, said: “We want to make sure the district is a clean, tidy and a nice place to live.

“Residents should not have to put up with the odour from decaying waste from their neighbours and so when people persistently refuse to co-operate with the council we will prosecute.”
